Terms of Service

Effective Date: January 1, 2025

By placing an order with Capital Studio ("Company," "we," or "us"), you ("Client") agree to the following Terms of Service:

1. Services Provided

Capital Studio provides real estate media services, which may include but are not limited to photography, videography, aerial/drone imagery, 3D tours, floor plans, and related media production.

2. Delivery of Media

Photos will be delivered by the following morning after the shoot.

Videos will typically be delivered within 2–3 business days.

Next-day video delivery may be possible depending on project complexity, but is not guaranteed.

Capital Studio does not accept rush orders. Clients are responsible for scheduling projects in advance and allowing adequate time for delivery.

3. Payment Terms

Payment is due upon delivery.

We reserve the right to withhold delivery of media until payment is received.

4. Usage Rights & Licensing

The Client is granted a non-exclusive, non-transferable license to use the media for marketing the specific property photographed.

Media may not be reused for other listings, agents, or purposes without prior written permission.

Copyright remains with Capital Studio unless otherwise agreed in writing.

5. Property Preparation

The Client is responsible for ensuring the property is clean, staged, and photo-ready prior to the scheduled shoot.

Capital Studio staff are not responsible for cleaning, staging, or moving items.

6. Drone & Aerial Services

Aerial services are subject to FAA regulations and weather conditions.

We reserve the right to cancel or reschedule drone work if conditions are unsafe or non-compliant.

7. Liability

Capital Studio is not responsible for any damage to property or belongings that occurs while performing services unless caused by gross negligence.

We are not liable for consequential damages, lost profits, or claims arising from use of the media.

8. Revisions & Edits

Basic editing is included.

Additional revisions or requests outside the original scope may incur extra fees.

9. Agreement

By placing an order, the Client acknowledges they have read, understood, and agreed to these Terms of Service.

1. Scheduling & Cancellations

Appointments must be scheduled in advance.

Cancellations or rescheduling made less than [24 hours] before the appointment may incur a cancellation fee of [half of the order total].

If we arrive at the property and are unable to access it, a trip fee may apply.

2. Refunds & Cancellations

Orders cancelled at least 2 day before the scheduled shoot will be eligible for a full refund.

Cancellations made less than 24 hours or day of shoot may result in a partial refund or cancellation fee that's half of the order total.

No refunds will be issued once services have been performed and media has been delivered.

In the event of technical issues, errors, Capital Studio will, at our discretion, provide either a re-shoot or a refund.
